Buying or Selling Property in Portugal from Abroad

A practical guide to powers of attorney, legalisation, Portuguese tax numbers, banking arrangements and transaction control

Portuguese real estate transactions attract buyers, owners and advisers who may be based in another country throughout the process. Distance does not prevent a purchase or sale, but it changes the importance of preparation. A missing signing power, an incorrectly legalised document or an unresolved banking requirement can become a completion problem even when the commercial terms have already been agreed.

In Portugal, a property may be bought or sold through a duly authorised representative. The practical objective is therefore not simply to appoint someone. It is to create a transaction structure in which the representative has the correct authority, the original documents are valid for use in Portugal, the parties are identified for tax purposes, and the movement of funds can be completed securely.

Key Takeaways

  • Use a transaction-specific Portuguese power of attorney rather than relying on general representation wording.

  • Confirm the required form, authentication and legalisation route before signing a document abroad.

  • Obtain the Portuguese NIF needed for the transaction and distinguish tax representation from signing authority.

  • Resolve bank onboarding, source-of-funds evidence and completion payment mechanics early.

  • Prepare the legal and operational file before making a binding commitment or fixing a completion date.

Why Remote Transactions Require Early Coordination

A property transaction combines several workstreams. The ownership and planning position of the asset must be reviewed; the buyer or seller must have the necessary identifiers and signing capacity; any financing or existing mortgage must be coordinated; taxes and costs must be funded; and the deed or authenticated private document must be completed with an agreed payment and possession process.

When the client is abroad, these tasks depend on documents crossing borders and on third parties operating to different timelines. Banks apply their own client due diligence requirements. Foreign signatures may require notarisation, an apostille or a consular route. Translations may also be needed. The safest sequence is to identify the full transaction path before the client signs abroad or commits funds.

Use a Transaction Specific Power of Attorney

The Portuguese term for a power of attorney is Procuração. For a property matter, broad wording that merely authorises general representation is often insufficient. The document should reflect the actual transaction and the acts that the representative is expected to perform.

Depending on the agreed scope, the authority may need to cover:

  • Buying or selling the identified property.

  • Negotiating and signing the promissory contract and the final deed or DPA.

  • Paying transaction taxes, charges and agreed costs.

  • Making or receiving payments through the approved completion mechanism.

  • Registering ownership and any mortgage after completion.

  • Managing financing, mortgage creation or mortgage discharge where applicable.

Banking, financing and mortgage powers deserve particular attention. If the representative is expected to interact with a bank, execute a mortgage document or deal with the repayment and discharge of an existing loan, those powers should be expressly considered. The wording should be agreed before execution, not corrected after an original has been signed and legalised.

Confirm the Legalisation Route Before Signing

A document signed outside Portugal must be prepared in a form that can be accepted in Portugal. The exact route depends on the issuing country, the document and the way in which the signature is authenticated. It may involve notarisation or another form of authentication, followed by an apostille or the appropriate consular process.

The practical rule is simple: confirm the form before execution. This reduces the risk of a client signing the wrong version, using an unsuitable certification, or sending an original that cannot be relied upon at completion. The need for a translation should also be assessed in advance, together with the form in which that translation must be provided.

Obtain the NIF and Separate the Roles

A Portuguese tax identification number, known as the NIF, is required for the property transaction. The usual preparation includes valid identification, proof of address and, where applicable, arrangements for representation. Obtaining a NIF does not, by itself, make a person Portuguese tax resident.

It is also important to separate three different concepts. A person who acts as tax representative is not automatically authorised to sign a property contract. A lawyer or other transaction representative is not automatically authorised to operate a bank account. A bank mandate is not a substitute for the powers required at the deed. Each role should be documented according to its purpose.

Plan Banking and Source of Funds

A Portuguese bank account is not legally mandatory for every property transaction, but it is often operationally useful. Taxes, mortgage finance, bank drafts and completion payments may be easier to coordinate through an account that is already active and funded. The relevant bank will determine whether remote opening is available and which onboarding documents it requires.

International buyers should expect requests concerning identity, address, occupation, wealth and source of funds. Sellers should establish where the balance will be received and whether the chosen receiving account can accept the payment without delay. These checks should not be left until the week of completion.

A Practical Remote Transaction Sequence

1.  Define the matter and the intended transaction, including whether the client is buying, selling, financing or discharging a mortgage.

2.  Identify the acts that must be performed in Portugal and prepare a transaction-specific power of attorney.

3.  Confirm authentication, apostille or consular requirements before the client signs abroad.

4.  Obtain the NIF and put any necessary tax representation in place.

5.  Open or confirm the banking route and assemble source-of-funds documentation.

6.  Complete the property review and negotiate the CPCV so that essential conditions are written into the contract.

7.  Prepare taxes, payment, deed or DPA, possession and keys before fixing completion mechanics.

8.  Register the completed transaction and retain the final legal, tax and banking records.

The Role of an International Adviser

An accountant, family office, lawyer or wealth adviser outside Portugal may remain the client's principal relationship manager while Portuguese professionals coordinate the local execution. The scope should be agreed clearly: who gathers the client documents, who verifies the property file, who manages the bank and who controls the completion checklist.

XP can coordinate the Portugal-side legal, tax, banking and completion work under an agreed scope. An initial non-confidential summary is usually sufficient to identify the relevant workstreams before sensitive documents are exchanged.

Frequently Asked Questions

Can I buy or sell a property in Portugal without travelling to Portugal?

Yes. A Portuguese property can be bought or sold remotely through a duly authorised representative. The authority and supporting documents must be suitable for the specific transaction.

Is a general power of attorney enough?

Not necessarily. General wording is often insufficient for a property transaction. The document should expressly cover the acts that the representative must perform, including any relevant banking, financing or mortgage powers.

Do I need a Portuguese bank account?

A Portuguese account is not legally mandatory in every case, but it is often operationally useful for taxes, financing and completion. Each bank applies its own onboarding and documentation requirements.

Does obtaining a NIF make me Portuguese tax resident?

No. Obtaining a Portuguese tax number does not itself create Portuguese tax residence. Tax residence depends on the applicable rules and the person's circumstances.

When should the remote transaction structure be prepared?

Before a binding commitment is made. Signing powers, legalisation, banking and essential contract conditions are easier to resolve before the CPCV or final completion timetable is fixed.

Discuss a Portuguese Property Matter

If you are buying, selling or advising a client from abroad, XP can define the Portugal-side scope and coordinate the work required from preparation to completion. Begin with a non-confidential summary of the property, the parties, the intended timing and any financing or mortgage position.
